中咨工程建设监理公司（以下称采购代理机构）受中华人民共和国商务部（以下称采购人）的委托，以公开招标方式选择商务部律师事务所库—世贸组织和区域贸易协定争端解决子库境外律师事务所，邀请符合资格条件的律师事务所（以下称投标人）参加投标。

CIECC engineering construction project management corporation (hereinafter referred to as “the procurement agency”), entrusted by ministry of commerce of the people's republic of china (hereinafter referred to as “the purchaser”), now invites eligible and qualified law firms (hereinafter referred to as “the bidder”) to submit sealed bids for selection of foreign law firms’ entry into the Ministry of Commerce’s Candidate List of Law Firms —Sub-List for WTO and RTA Dispute Resolution (Foreign Law Firms) by public competitive bidding.

一、招标内容

I. Bidding contents

商务部律师事务所库—世贸组织和区域贸易协定争端解决子库境外律师事务所，最大中标人数量为15家。符合资格条件的投标人为8-15家时,淘汰综合得分排序最后的1家。

For the project of Ministry of Commerce’s Candidate List of Law Firms —Sub-List for WTO and RTA Dispute Resolution (Foreign Law Firms), the maximum number of the winning bidder shall be 15. if the number of the eligible and qualified bidder is between 8 to 15, the last one in comprehensive score shall be phased out.

二、投标人资格

II. Qualifications Of The Bidder

投标人应当具备下列条件：

  The bidder shall meet the following conditions:

（1）投标人应为在中国境外合法设立的律师事务所（含在港澳台地区注册的律师事务所）；投标人不得以其驻华代表机构的名义投标，但可通过其驻华代表机构办理相关事宜；

The bidder shall be a law firm legally established outside the territory of China (including Hong Kong SAR, Macao SAR or Taiwan Province of China); the bidder shall not submit bids in the name of itsrepresentative office in China, but can deal with the relevant matters throughthe representative office.

（2）具有良好的商业信誉和健全的财务会计制度；

Having good business reputation and sound financial and accounting system;

（3）具有承办委托法律服务事项的团队和能力。

Having a team with the ability to undertake the entrusted legal services.

（4）已购买本项目招标文件。

Having bought the bidding document of this project.

三、招标文件的获取方法

III. Method of obtaining the bidding document

（1）招标文件发售时间：2015年9月16日上午9：30至2015年10月15日下午4：00。（北京时间）

Time availability of the bidding document: starting from 9:30 am September 15, 2015 to 4:00 pm October 15 , 2015. (Beijing time)

（3）招标文件售价：500元人民币或80美元或70欧元，售后不退。

Non-refundable payment of RMB 500 Yuan or $ 80 or 70 Euros for each bidding document.

四、投标

IV. Submission of bids

（1）投标截止时间：2015年10月16日9:30（北京时间）

Deadline for bid submission: 9:30am October 16, 2015, (Beijing time)

（2）中标服务费：

投标人如中标，应向采购代理机构缴纳4000元人民币（或等值的美元或欧元）中标服务费；当中标人数量10家（含）以内时，投标人如中标，应向采购代理机构缴纳5000元人民币（或等值的美元或欧元）中标服务费。

The bidding service fee: if winning the bid, the bidder shall pay RMB 4000 Yuan or equivalent sum of US Dollars or Euros to the procurement agency. If the number of the winning bidders is less than 10 (including), each winning bidder shall pay service fee RMB 5000 Yuan or equivalent sum of US Dollars or Euros to the procurement agency.

五、投标文件递交地点：

V. Bids delivery

投标截止时间之前递交的，可以专人送达，也可通过邮寄送达。邮寄送达的投标文件递交时间以采购代理机构签收时间为准。

Bids may be delivered in person or by mail before the deadline. In case of mail delivery, the time of receiving and signing the bids by the procurement agency will be regarded as the time of the bid submitted.

六、开标

VI. Bid opening

采购代理机构将于2015年10月16日9:30（北京时间），在中国咨询集团二层会议室举行开标仪式。投标人可派代表出席。

The procurement agency will hold the bid opening ceremony at 9:30am October 16, 2015

(Beijing time) at the second floor boardroom of China International Engineering Consulting Corporation. Bidders can send representatives to attend.
