Bidding Announcement

中咨工程建设监理公司（以下称采购代理机构）受中华人民共和国商务部（以下称采购人）的委托，以公开招标方式选择商务部律师事务所库—贸易壁垒调查与应对子库律师事务所，邀请符合资格条件的律师事务所（以下称投标人）参加投标。

CIECC Engineering Construction Project Management Corporation (hereinafter referred to as the “Procurement Agency”), entrusted by Ministry of Commerce of the People's Republic of China (hereinafter referred to as the“ Purchaser”), now invites eligible and qualified law firms (hereinafter referred to as the “Bidder”) to submit sealed bids for selection of law firms’ entry into the Ministry of Commerce’s Candidate List of Law Firms —sub-list for Trade Barrier Investigation and Response by public competitive bidding.

Ⅱ.Qualifications of the Bidder

投标人应当具备下列条件：

  The Bidder shall meet the following conditions:

（1）投标人应为合法注册的律师事务所,港澳台地区注册的律师事务所参加境外律师事务所包的投标；

Bidders shall be legally registered law firms. Law firms registered in Hong Kong SAR, Macao SAR and TaiwanProvince should participate in the Package of Foreign Law Firms (barrier);

（2）具有独立承担民事责任的能力；

Having the ability to independently bear civil liabilities;

（3）具有良好的商业信誉和健全的财务会计制度；

Having good business reputation and sound financial and accounting system;

（4）具有承办委托法律服务事项的团队和能力；

Having a team with the ability to undertake the entrusted legal services.

（5）第1包和第3包投标人应有依法缴纳税收和社会保障资金的良好记录；

Bidders for Package No.1 and 3 shall have a good record of paying taxes and social security funds　in accordance with the laws;

（6）第1包和第2包投标人应具有承担美国337调查案件的业绩或有从事美国337调查案件业绩的律师, 第3包和第4包投标人应具有境内外贸易壁垒调查案件的业绩或有从事贸易壁垒调查业绩的律师。

Bidders for Package No.1 and 2 shall have the performance of undertaking U.S. 337 investigation case or the lawyer engaged in  the performance of U.S. 337 investigation case and bidders for Package No. 3 and 4 should have the performance of investigation cases of trade barriers inside and outside China or the lawyer engaged in the performance of investigation cases of trade barriers inside and outside China;

（7）已购买本项目招标文件。

Having bought the bidding document of this project.

三、招标文件的获取方法

（1）招标文件发售时间：2015年9月 16日上午9：30至2015年10月15日下午4：00。（北京时间）

Time availability of the bidding document: starting from 9:30 am September 16, 2015 to 4:00 pm October 15 , 2015. (Beijing time)

（2）招标文件发售地址：北京市海淀区车公庄西路25号中国咨询集团（东203）室

Place of selling bidding document: Room 203 East Building, No. 25 Chegongzhuang West Road, Haidian District, Beijing, China

（3）招标文件售价：500元人民币或80美元或70欧元，售后不退。

Non-refundable payment of RMB 500 Yuan or $ 80 or 70 Euros for each bidding document.

（4）招标文件需要邮寄的，招标文件费用汇款到以下账号：

四、投标

Ⅳ.Submission of Bids

（1）投标截止时间：2015年10月16日9:30（北京时间）

Deadline for bid submission: 9:30am October 16, 2015, (Beijing time)

（2）中标服务费：

Bidding service fee

投标人如中标，应向采购代理机构缴纳中标服务费每包5000元人民币（或等值的美元或欧元）。

If winning the bid，the Bidder shall pay the Procurement Agency in amount of RMB 5000 or equivalent sum of US Dollars or Euros for bidding service.

五、投标文件递交地点：

Ⅴ.Bids Delivery

投标截止时间之前递交的，可以专人送达，也可通过邮寄送达。邮寄送达的投标文件递交时间以采购代理机构签收时间为准。

Bids shall be delivered by direct service or by post before the date of the deadline. The mail delivery time as signed by Procurement Agency will be deemed as the bid’s delivery time.

六、开标

Ⅵ. Bid Opening

采购代理机构将于2015年10月16日9:30（北京时间），在中国咨询集团二层会议室举行开标仪式。投标人可派代表出席。

The Procurement Agency will hold the bid opening ceremony at  9:30am October 16, 2015, (Beijing Time) at the second floor boardroom of China International Engineering Consulting Corporation. Bidders can send representatives to attend.
